Après trois ans de bataille juridique, le tribunal administratif de Paris a condamné l’État français ce jeudi 14 octobre. Celui-ci doit en effet réparer le préjudice de ces trois dernières années, en matière de climat. La France a jusqu’au 31 décembre 2022 pour agir et prendre des mesures, sous peine de devoir en répondre financièrement à la justice. En effet, celle-ci a reconnu que l’inaction de l’État en matière de climat était illégale.
En cause, l’émission de 15 millions de tonnes de CO2 entre 2015 et 2018.
C’est grâce notamment à la mobilisation de quatre ONG, dont GreenPeace et Oxfam France, mais aussi à L’Affaire du Siècle, que cette affaire a pu aboutir en faveur de notre environnement.

Vers une justice climatique
La justice vient de reconnaître l’illégalité de l’inaction climatique de l’État, et donc sa responsabilité. La procédure juridique n’est pas terminée, et le tribunal de Paris devra décider des mesures supplémentaires à prendre par la France. Objectif : réduire les émissions de gaz à effet de serre et enfin respecter ses engagements pris initialement pour le climat. La prochaine audience aura lieu au printemps 2022, et l’État peut aussi faire appel de cette décision. Il reste néanmoins que les ONG, juristes, avocats, ainsi que les 2,3 millions de personnes ayant rejoint cette action font de cette affaire une gigantesque mobilisation en faveur du climat.
Rappelons que l’État français avait été déclaré coupable d’inaction climatique le 3 février dernier. En décembre 2018, La Fondation Nicolas Hulot, Oxfam, Greenpeace et l’association Notre Affaire, avaient lancé une campagne de justice climatique. Elle visait l’État français pour son inaction dans la lutte contre l’urgence climatique. Sur les réseaux sociaux, cette décision est au cœur des polémiques notamment pour la présidentielle 2022, avec le hastag #PasDeClimatPasDeMandat
